Multnomah County District Attorney Rod Underhill announced a grand jury returned a 23 count indictment against 58-year-old Timothy Joseph Mackley for his alleged involvement in the homicide of 89-year-old Marcine Herinck.
The indictment, which was filed on October 3, 2018, charges Mackley with 13 counts of aggravated murder, one count of intentional murder, four counts of burglary in the first degree, two counts of kidnapping in the second degree, two counts of sexual abuse in the first degree and one count of abuse of a corpse.
According to the indictment, Mackley is accused of killing Herinck on or between September 18 and September 24.
It is alleged in the indictment that the defendant unlawfully entered Herinck’s residence in the 1500 block of Northeast 150th Avenue in Portland, Oregon on or between September 18 and September 19, 2018 where he kidnapped her and took her from one place to another without consent and with the purpose of terrorizing Herinck and/or with the purpose of causing physical injury. Furthermore, it is alleged that Mackley sexually abused Herinck during the six day period when she was missing. Finally, the indictment alleges that upon killing Herinck, the defendant intentionally removed and transported her remains.
On September 24, 2018, officers performed a traffic stop on a vehicle that was being driven by Mackley in the 9200 block of Southeast Holgate Boulevard. During the investigation, the body of Herinck was discovered inside the vehicle’s trunk. Mackley was taken into custody and booked into the Multnomah County Detention Center.
Herinck was reported missing on September 19, 2018.
Mackley is scheduled to be arraigned on the indictment at 9:30 a.m. on October 4, 2018 at the Multnomah County Justice Center before Judge Angel Lopez. Mackley remains in custody at the Multnomah County Detention Center on a no bail hold.
